The rapid development of the construction industry and the increase in residential sales, together with new regulations, are also required. The Law on the Protection of the Consumer, numbered 6502, which is organized for this purpose, is also having a bad day for new regulations for the sale of the house.

In the law entered into force on 28 May 2014, the right of housing delivery and return of the contract is explained in Article 44 and Article 45. According to the provisions contained herein, the transfer or delivery period for the sale of prepaid housing does not exceed thirty-six months from the contract date.

Delivery of housing

Article 44 of the law regulates the period of housing delivery. This does not exceed thirty-six months from the contract date for the sale or delivery of prepaid housing. With the registration of the flat easement to the title deed in the name of the consumer, it is deemed to have been transferred and handed over in the state of possession.

Return without a contract

In Article 45 of the same law, this time the right to return from the contract made to the consumer is brought. According to this article, the sale of prepaid housing is allowed to return to the consumer without giving any reason until the date of transfer or delivery.

In case of returning from the contract; The expenses arising from the tax, duties and similar legal obligations arising from the sale or sale promise contract of the dwelling and the payment of the compensation up to two percent of the contract amount.

If the seller fails to fulfill his obligations in the event of a contractual return, he can not claim any price from the consumer. Consumers can not be asked for any compensation in case of a loss of the consumer or a loss of earnings due to the continuous deprivation of income, or a non-acceptance by the seller of a proposal for the placement of a sales contract in a hireable condition, instead of the contract.

The amount to be returned to the consumer which puts the consumer into debt shall be returned to the consumer within 90 days at the latest from the date of return of the return notification to the seller. In addition, from the date the seller returns all kinds of documents that cause the consumer to pay the price and the consumer, the consumer must also return all gains in ten days.
